Terms and Conditions

These Booking Terms & Conditions, along with any other written information presented to you prior to confirming your booking, are applicable to your reservation with Akdeniz Villam Turizm Emlak Insaat ve Ticaret Ltd. Sti., trading as Kalkan Escapes ("we," "us," "our"), (registered address Kalkan, Sehitler Cd. 67/1, 07960, Kas/Antalya. Trade Registration Number: Kas - 3188. Tax ID Number: 0211035088). It is important that you carefully review these terms as they outline our respective rights and obligations. In these Booking Terms & Conditions, the terms "Your," and "You" refer to the person making the property booking. 'Owner' refers to the principal, owner or representative of the property.

By making a booking, the first named person on the booking agrees on behalf of all persons named in the booking that:

a. You have read and understood these Booking Conditions and willingly consent to be bound by them.

b. You provide your consent to our use of personal data as outlined in our Privacy Policy. Additionally, you are authorized to disclose the personal details of all individuals named in the booking, including any special categories of data (such as health conditions, disabilities, and dietary requirements), where applicable.

c. You confirm that you are over 18 years of age. If you are making a booking for services with age restrictions, you declare that both you and all members of your party meet the required age criteria.

d. You accept financial responsibility for the payment of the booking on behalf of all persons named in the booking.

Prices

We retain the right to modify published prices at any given time. Moreover, we reserve the right to rectify any inaccuracies in both advertised and confirmed prices. Occasionally, changes and errors may arise. Therefore, it is imperative that you verify the price of your selected arrangements at the moment of booking.

Capacity

The number of occupants in the Property must not exceed the advertised capacity, unless prior written consent is obtained. In the event of a breach of this condition, owners reserve the right to terminate the booking without refund and retain the full security deposit.

Check-in and Check-out

The official time for check-in to your accommodation is 16:00. The cleaners have exclusive access to the accommodation until this time to prepare for your arrival. Therefore, entry to the accommodation before this time will not be permitted. Check-out time for all accommodations is 10:00.

Pool and Garden Maintenance

All rental properties listed on our website are maintained by staff appointed by the owners. These staff members have access to the swimming pool and garden areas .Gardens must be maintained on a regular basis, and it is simply not possible for this to be carried out on 'change-over' days.

Swimming pools are also regularly inspected, typically in the early morning, to avoid any inconvenience during your stay at the property. However, please note that the pool and garden personnel do not have fixed working hours, so we are unable to provide you with the exact date or time of their visit. We kindly request your cooperation when the staff members come for their routine checks.

Booking

To make a booking, you need to select your desired accommodation and submit your booking request accordingly. Once we receive your request, we will promptly check the availability with the Owner. Upon confirmation, you will be required to make the applicable deposit to secure your booking. Please note that your booking is only confirmed once you receive a booking confirmation from us on behalf of the Owner. The information you provide for the booking will be shared only with the relevant Owner or individuals involved in providing your accommodation. By making this booking, you consent to the sharing of this information with the necessary parties.

Payment

To secure your chosen accommodation, you must pay a non-refundable 30% deposit or full payment is required if booking within 8 weeks of departure. Please note that all applicable bank transfer fees and booking fees must also be paid.

If a deposit has been made, the final balance is payable upon arrival at your accommodation. The final balance must be paid in cash or by credit or debit cards. Please note that for credit or debit card payments towards the final balance, we retain the right to levy a 4% administration fee.

Security Deposit

All bookings require a refundable security deposit to protect Owners against breakages, loss, damage or extra cleaning. This deposit must be paid in person during check-in and will be returned to you during check-out, unless there is any damage or loss at the property. Please be aware that you remain responsible for any repairs, replacements or other losses incurred by the Owner due to accidental or negligent breakage, loss, damage or injury to the Property and/or its contents, regardless of the security deposit held. In the event of any breach of this agreement, we reserve the right, upon instruction from the Owner, to deduct additional charges from the security deposit. Before check-out, it is required that you leave the accommodation in the same clean, tidy and well-maintained condition as it was upon your arrival. Any additional cleaning, laundry or rubbish disposal required may be charged against the security deposit. If you have any disputes regarding deductions from the security deposit, please address them directly with the Owner or us. Please note that any breakages, damage or loss caused to the Property or its contents during the rental period may result in the forfeiture of some or all of the security deposit. We, as the agent, are not authorized to engage in any correspondence regarding the security deposit.

Your Responsibility

The property is exclusively advertised for short-term holiday lets. Subletting or using it for any other commercial purposes without the Owner's express written consent is strictly prohibited. Failure to comply with this condition may result in the termination of your booking without a refund.

For event bookings such as weddings, parties, single-sex groups, stag and hen parties, prior written agreement from the Owner is required. Non-compliance with this condition may lead to the termination of your booking without a refund.

Please be aware that event bookings may incur additional charges, venue hire fees, and a higher security deposit in addition to the standard website rental rates and fees.

You, along with the members of your party and any other visitor/s, take proper care to secure the property at all times and keep track of the property key(s). In the event of key loss, you will be responsible for the cost of replacing them.

Pets are not allowed in rental properties unless there is a written agreement from the Owner or us.

You, along with the members of your party and any other visitor/s, are not allowed to smoke or permit smoking inside the rental property at any time.

Cancellations and Changes by You

Cancellations must be requested via email by the lead name on the booking using the registered email address. The effective date of cancellation will be the delivery date of the cancellation email. Please be aware that all cancellations are subject to a charge which will be detailed in an invoice sent within two weeks of the cancellation. It is important to note that these charges also apply if your booking is cancelled due to a failure to make payment on time. Additionally, if you decide to switch your accommodation from one property to another, it will be considered a cancellation and the same charges will be applicable. 

You will lose your deposit ( %30 ) if you have more than 80 days before your holiday start,
you will be charged %50 if you have 79-60 days,
you will be charged %100 if you have 59 days or less.

No refund will be issued for any unused portion of your holiday in the event that you decide to conclude your stay earlier than initially scheduled.

Changes and Cancellations by the Owner

We will promptly notify you if the Owner requires a substantial modification to your confirmed accommodation or needs to cancel it. We will also facilitate communication between you and the Owner regarding any alternative accommodation options, though we shall not be held liable beyond these responsibilities.

Liability

Personal belongings, vehicles and their contents belonging to you and other members of your party are left at the Property entirely at your own risk. We shall not be held liable for any loss or damage to your personal belongings and vehicles, including their contents, throughout the duration of your holiday.

We do not accept any responsibility or liability for acts of omission of third parties which may prevent or disrupt a customer's booking. The booking contract exists between us and you and is limited to the rental of the property for a short period of time and associated services only. 

The information and descriptions provided are considered accurate and presented in good faith. However, please note that certain features or facilities may occasionally be unavailable, and we cannot be held responsible for such instances. Factors such as local circumstances, maintenance or repair requirements (e.g., swimming pools), adverse weather conditions, fuel shortages, power cuts, or other circumstances beyond our control may contribute to these situations. In such cases, we cannot be held liable. Please be aware that refunds or compensation will not be issued and standard cancellation charges will still apply.

We shall not be held responsible for any temporary defects or disruptions in public services such as water, electricity, gas, telephone or internet at the property, nor for any issues with equipment, machinery or appliances in the property or garden that arise due to circumstances beyond our control.

We cannot accept liability for any injuries, losses, or damages to you, your party members, or the Property resulting from the use of the Property. It is your responsibility to provide constant supervision for all children or vulnerable adults in your party, particularly in and around the swimming pool.

Your Behaviour

All our guests are expected to maintain orderly and appropriate conduct, ensuring a pleasant experience for everyone. If, in our opinion or the Owner of the Property, your behavior or that of any member of your group causes or is likely to cause distress, danger, annoyance to other guests or third parties or damage to property or results in transportation delays or diversions, we reserve the right to immediately terminate your booking. In such cases, our liability to you and your group will cease and you will be required to vacate your accommodation or make alternative arrangements promptly. We will have no further obligations or provide refunds for lost accommodation or any other arrangements. Furthermore, we will not be liable for any expenses or costs incurred as a result of termination. You and your group may also be held responsible for any losses or damages caused by your actions and each member of your group will be jointly and individually liable. Please note that we cannot be held accountable for the actions or behavior of other guests or individuals unrelated to your booking.

Complaints Procedure

We sincerely hope that you won't encounter any issues, but in the event that you do, please promptly notify us or the Owner of the accommodation. Most problems can be swiftly resolved on-site. It is important to note that if you fail to notify us or the Owner about any problems or dissatisfaction before departing from the Property, we may not be able to assist you at all.

Specific Requests

If you have any specific requests (such as dietary requirements, cots or room preferences), please inform us during the booking process. We will relay all your requests to the Owner. However, please note that we cannot guarantee their fulfillment and we will not be held liable if they cannot be accommodated.

Force Mejeure

We are not liable or obligated to provide compensation if the performance of our contractual obligations is hindered or affected by events constituting Force Majeure. Force Majeure includes acts of war or the threat of war, political instability, terrorist activities, adverse weather conditions, volcanic ash clouds, strikes, acts of God, epidemics, riots, civil unrest, industrial disputes, terrorist activities, natural or technical disasters, and nuclear war, or any similar events beyond our control.

Invoicing Process

Kalkan Escapes invoices the amount of the service fee made due course of laws for each booking. On the other hand property owner is responsible for invoicing amounts other than the service fee.

Taxing

In the taxation of income from premises, according to the regulation determined by the Presidency of Revenue Administration, procedures such as liability to taxing, benefiting from exemptions, declaration, accrual, tax payment are subject to the provisions of the laws of the Republic of Turkey.
